The following terms and conditions constitute an agreement between you and eHealthdoc Ltd.

Whenever we use the words “your physician”, “your doctor”, “your healthcare provider” or similar words on eHealthdoc, including in these Terms of Use, we mean your personal doctor or family GP with whom you have an actual ongoing doctor-patient relationship. eHealthdoc medical experts are not “your” physician, healthcare provider, or GP.

eHealthdoc provides online consultations, issues medical certificates, and provides home visits from doctors who will serve you to the best of their ability under the following terms and conditions:

Using the eHealthdoc website

No ongoing doctor-patient relationship. eHealthdoc does not replace your relationship with your Physician, GP, or healthcare provider. The information offered should not be relied upon as a substitute for sound professional medical advice, evaluation, or care from your physician or other qualified healthcare provider. This information should be put to use alongside consultation with your physician or other healthcare provider.

You acknowledge that although some of the content, text, data, graphics, images, information, suggestions, guidance, and other material that is provided to you on the Site (including Information provided in direct response to your questions or postings) may be provided by individuals in the medical profession, the provision of such information does not create a doctor/medical professional-patient relationship, but is provided to inform you on various medical conditions, medical diagnosis and treatment and it does not constitute a direct medical diagnosis, treatment or prescription. Everything on eHealthdoc should be used for information purposes only.

eHealthdoc is intended to support the health decisions and choices that you make. These decisions and choices are yours, and we believe that you, in connection with the advice you receive from your doctor or other professional healthcare provider, are the best decision-maker about your health. We cannot make decisions for you. What we can do is help you find reliable health information and connect with doctors for in-person information. We hope these services will be of value to you. Please use them responsibly.

Whenever you require personal medical advice, treatment, or diagnosis, you should contact your physician or professional healthcare provider and see them in person.

All users must be eighteen years or older. In the case of minors (under eighteen (18) years), a parent or guardian must accept this Agreement and guide all consultations under the services offered.

Your right to use the Services is not transferable

THE SERVICES ARE NOT FOR USE IN MEDICAL EMERGENCIES OR FOR CRITICAL HEALTH SITUATIONS REQUIRING PROMPT MEDICAL ATTENTION.

The service is not intended to be real-time and may not be the best solution when a face-to-face consult is a must.

The User takes full responsibility for ensuring that the information submitted is accurate. eHealthdoc shall make no effort to validate any information provided by the Consumer for use in Services with respect to content, correctness, or usability. We with an intention to provide the best service possible could ask you to share more information as and when needed.

Use of eHealthdoc Services requires basic familiarity with the Internet, related payment services, and general security practices. The Consumer is expected to possess the necessary internet usage skills and knowledge to avail eHealthdoc Services.

Independence of doctors

The opinions, statements, and answers provided by doctors via eHealthdoc are solely the individual and independent opinions and statements of such individuals and do not reflect the opinions of the company, its affiliates, or any other organizations or institutions to which such doctor or specialist or is affiliated or provides services. eHealthdoc does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on eHealthdoc.

You are solely responsible for maintaining the confidentiality of your password and for all activities carried out under your eHealthdoc account. You agree to prohibit anyone else from using your password and immediately notify eHealthdoc of any unauthorized use of your password or other security concerns.

Your affirmative act of using this Site and/or registering for the Site or the Services constitutes your electronic signature to these Terms of Use and your consent to enter into agreements with us electronically.

Scope of Services

eHealthdoc (the owners and the employee staff of the Site) and third-party professionals who offer services through the Site accept no responsibility for any medical, legal, or financial events or outcomes related to services achieved through the use of the Site.

eHealthdoc does not guarantee that a home visit, web-based consultation, over-phone consultation, or video consultation is the appropriate course of treatment for your particular health problem. You agree to contact your primary care physician immediately should your condition change or your symptoms worsen. If you require urgent care, you agree to contact your local emergency services immediately. The Services are offered on an “as is” and “as available” basis and used by the Consumer solely at his or her own risk.

eHealthdoc makes no warranty that the Services will meet your requirements, or that the Service(s) will be uninterrupted, timely, secure, or error-free. This includes loss of data or any service interruption caused by eHealthdoc employees. eHealthdoc is not responsible for transmission errors, or corruption of data.

A telehealth consultation will be conducted through our telehealth facilities once this has been requested for the purposes of obtaining a medical certificate. Please be aware that this consultation does not replace the advice of your regular GP/healthcare provider and you must ensure that you make an appointment with your GP to discuss your healthcare concerns. The eHealthdoc doctor who conducts this consultation will only be able to certify that he has confirmed that you are unable to attend your usual place of work for the specified dates due to a medical condition. The doctor is not there to replace your regular GP/healthcare provider and will not be in a position to advise you of any ongoing management of your medical condition. It is your responsibility to make an appointment with your own doctor to discuss your condition immediately. eHealthdoc bears no responsibility for your ongoing medical care, nor in the event that your condition worsens are we to be held responsible for any adverse outcomes.

All eHealthdoc doctors are AHPRA-qualified GPs. We do not replace the care provided by your regular GP and are there to support you at times when you are unable to access your regular GP/ Medical provider.

Medical Certificate Issuance

  1. Issuance Limitations: The Service is restricted to issuing medical certificates for a duration not exceeding two consecutive days.
  2. Prohibited Certificates: The Service does not authorize the issuance of:
    • Certificates with retrospective effect.
    • Certificates attesting to fitness for air travel.
    • Certificates confirming fitness to resume work.
    • Certificates endorsing fitness for activities or duties extending beyond a two-day period.
    • Certificates for exemption from jury duty obligations.
    • Certificates for exemption from probation requirements.
    • Certificates for exemption from attending mandated court hearings.

Prescription Services

  1. Available Prescriptions: The Service provides prescriptions for:
    • Refills of previously prescribed medications.
    • Antibiotic medications.
    • Basic analgesic treatments.
  2. Prescription Exclusions: The Service is expressly prohibited from prescribing the following classes of medication:
    • Schedule 8 (S8) Controlled Drugs, including but not limited to oxycodone and other opioid medications.
    • Benzodiazepines, such as diazepam.
    • Medications typically prescribed for Attention Deficit Hyperactivity Disorder (ADHD).
    • Medications classified as sleeping aids.
    • Schedule 4 (S4) Drugs, including but not limited to panadeine forte and codeine-based treatments.

These restrictions are in place to comply with regulatory guidelines and ensure patient safety under the operational scope of telehealth services provided by eHealthdoc. Users are advised to consult with their primary care provider for needs beyond the scope of this service.

Patient’s Profile on eHealthdoc

Your eHealthdoc Patient Profile is created to store records of your consultations and your personal health information online, including history, health conditions, allergies, and medications.

  • Any information provided as part of a home visit, web, over-phone, or video consultation becomes part of your eHealthdoc Record. You agree to provide accurate information to help us serve you best to our knowledge, to periodically review such information, and to update such information as and when necessary.
  • eHealthdoc reserves the right to maintain, delete, or destroy all communications and materials posted or uploaded to the eHealthdoc Service according to its internal record retention and/or destruction policies.
  • You might be contacted via email to review the information provided by you for eHealthdoc Records or for Online Consultations. Please make sure you provide a valid email-id and you update it as and when needed.

We are not responsible for anything outside of eHealthdoc. Now or in the future, the Content and Services may link you to other websites or information, software, data, or other contents, on or off the Internet. We do not control, endorse, or review the content of these sites, and we are not responsible for such content.

Informed Consent for eHealthdoc Services

As with any medical procedure, there are potential risks associated with eHealthdoc services. By using the eHealthdoc service, you agree to abide by the Terms and Conditions, Privacy policy, and risks described below. These risks include, but may not be limited to:

While eHealthdoc is an honest attempt to provide access to the best possible medical information to the patient, the doctors may not be examining you physically. The doctor may not have access to all or some of your medical history it might be critical to consult you. The doctor may not have the benefit of information that would be obtained by examining you in person, observing your physical condition, and by going through your medical records. This means that the service provided through eHealthdoc may be different from the diagnostic and treatment services typically decided by a physician. Therefore, the physician may not be aware of facts or information that would affect his or her opinion of your diagnosis. To reduce the risk of this limitation, eHealthdoc strongly encourages you to be in touch with your own doctor and share the eHealthdoc opinions with him/her. By deciding to engage in this service, you acknowledge and agree that you are aware of this limitation and agree to assume the entire risk of this limitation;

By requesting an eHealthdoc, medical certificate, or an online consultation you acknowledge and agree that:

  • The advice/information/opinion on the diagnosis you may receive could be limited and provisional;
  • The online eHealthdoc advice is not intended to replace a face-to-face visit with a physician and it doesn’t replace an actual Doctor-patient relationship;
  • In case of a second opinion where there is a difference of opinion among our doctors and your physician, you would bear the responsibility to decide the next step. We hope to help you in making the right decision but in the end, it is only up to you to share our doctor’s opinion with your physician or to go for another physical exam.
  • The doctor is reliant on information provided by you and hence any information demonstrated to have been falsified will immediately render the opinion and all details therein null and void;
  • Where a medical certificate is provided, this will only state the factual information that you have provided, by stating that you suffer from a medical condition and will be unable to attend work on the specified dates.
  • Where a home visit has been conducted, the history and physical examination will help the doctor reach his/her diagnosis and based on this a management plan will be formulated.

In some cases, the doctor may determine that the transmitted information is of inadequate quality and may ask for more information, without which he/she may refuse to answer the query;

In rare cases, the doctor may feel that the query may not be answerable without physically examining the patient and the consult may be refused forthwith;

In very rare instances, security protocols could fail, causing a breach of privacy of personal medical information;

Delays in medical evaluation and answers could occur due to deficiencies or failures of the service as per those mentioned in the Terms of Use.

It may also be the case that the doctor will be unable to provide you with a medical certificate based on the information provided. The reasons for this will be explained and you will be advised on the best course of action.

Each consultation, whether it be a visit, an e-consultation or the provision of a medical certificate will require you to be followed up by your own doctor within 24 hours to reassess your condition. You are responsible for making any follow-up arrangements with your own regular GP/healthcare provider.

Protection of Proprietary Information

You agree that the Services, which include all software and information, both electronic and printed media, contain copyrighted material, trade secrets, patent-related material, and other proprietary intellectual property and are the proprietary property of eHealthdoc. They are protected by copyright, trade secret, patent laws, and other proprietary rights and laws, and they may only be used or accessed as specifically provided for, in this Agreement.

You agree that you will not store, copy, modify, rent, lease, loan, sell, distribute, transfer, transmit, display, reverse-engineer, reverse-assemble, or otherwise attempt to discover any programming code or any source code used in or with the Services. You will not otherwise attempt to transfer any right in the Services (which includes its software, design, and content), create derivative works based on it, or in any manner commercially exploit the Services in whole or in part.

With the exception of your medical records, eHealthdoc retains all rights, titles, and interests pertaining to eHealthdoc, the eHealthdoc Services, and any content, products, documentation, software, or other materials on the eHealthdoc website along with any patent, copyright, trade secret, trademark, service mark or other intellectual property or proprietary right in any of the foregoing.

Contact us if you believe the information on our website infringes your copyright. If you believe any materials accessible on or from eHealthdoc infringe your copyright, you may request the removal of those materials.

Electronic Payment

You agree, understand, and confirm that payment details provided by you for availing services of eHealthdoc will be correct and accurate. You confirm that you shall not use credit cards that are not lawfully owned by you.

Other than to carry out the payment transaction, your payment information will not be utilized or shared by eHealthdoc with any of the third parties unless required by law, regulation, or court order. The said information will not be kept longer than necessary for providing the services.

eHealthdoc cannot assist with a stop payment request for any payment scheduled using a Payment Account credit/debit card. In any such case, you must immediately and directly contact your credit/debit card company/bank.

Payment Policy

All fees have to be paid upfront before availing a particular service on the eHealthdoc website.

At this stage of operations once a request for service is submitted no calls for refunds owing to cancellation of request will be considered.

The patient can appeal against this decision in which case there will be a review process.

If this process finds that the service was not delivered to a satisfactory level that would be expected by eHealthdoc then a suitable resolution to the dispute will be addressed according to our terms and conditions

Suspension due to non-compliance with the Agreement

eHealthdoc will make all possible efforts to provide you with the best services for your payment. However, eHealthdoc shall not incur any liability and shall declare any service guarantee void in the event of one or more of the following circumstances:

  • If you have not provided accurate patient details including contact information (patient’s email and/or phone number), username, and Payment account information.
  • If the transaction for payment doesn’t go through with your bank due to (including but not limited to) insufficient funds, fraudulent access, or failure to process the request by our Affiliate merchants or your bank.
  • If you don’t respond to requests for more information (if needed) by the specialists or doctors to make a consultation
  • If the user is in breach of any of the Terms and Conditions of this Agreement and/or the Terms and Conditions of the usage of eHealthdoc.

Disclaimers

You acknowledge that your use of the eHealthdoc Services is solely at your own risk and that you assume full responsibility for all risks associated therewith. To the extent that any of the Content included on eHealthdoc is provided by third-party content providers or other users, we have no editorial control or responsibility for such content appearing on eHealthdoc. All information, products, or services contained on or provided through this website are provided “as is”, without any warranty of any kind, express or implied, to the fullest extent permissible under applicable law. eHealthdoc and its Affiliates hereby disclaim all representations and warranties, express or implied, statutory or otherwise, including but not limited to warranties of merchantability, appropriateness, title, non-infringement, and freedom from virus strains.

In no event shall eHealthdoc nor any of its affiliates be liable for any direct damages in excess of the purchase price for the product. In addition, to the maximum extent permitted by law, in no event shall eHealthdoc nor any of its affiliates be liable for any special, punitive, indirect, incidental or consequential damages, including but not limited to personal injury, wrongful death, loss of use, loss of profits, interruption of service or loss of data, whether in any action in warranty, contract, tort (including, but not limited to negligence or fundamental breach), or otherwise arising out of or in any way connected with the use of, or the inability to use, this website or any service offered through this website or any material or information contained in, accessed through, or products purchased on this website, even if an authorized representative of eHealthdoc is advised of the likelihood or possibility of the same. To the extent certain jurisdictions restrict any of the above limitations of liability; such limitations shall not apply in such jurisdictions to the extent of such restrictions.

Right to Operational Functionality

eHealthdoc reserves complete and sole discretion with respect to the operation of our Services. We may, among other things withdraw, suspend, or discontinue any functionality or feature of our Services.

Right to Modify Terms of Service

You agree and confirm that the Terms of Service may be amended from time to time without notice and take responsibility to update yourself periodically with the latest version available on the eHealthdoc website. Any such revision or change will be binding and effective immediately on release of the revised Agreement or change to the Service(s) on our website. Unless we notify otherwise, these terms incorporate and supersede any other terms associated with the Services.

eHealthdoc has the right to discontinue service or deny access to anyone who violates our policies or the terms and conditions stated herein, without prior notice or warning.

eHealthdoc may freely transfer, assign, or delegate all or any part of this Terms of Use, and any rights and duties hereunder. These Terms of Use will be binding upon and inure to the benefit of the heirs, successors, and permitted assignees of the parties.

Assignment

We may assign this contract at any time to any parent, subsidiary, or any affiliated company, or as part of the sale to, merger with, or other transfer of our company to another entity. We will post a notice on the Site regarding any change of ownership so that you have the opportunity to discontinue your use of the Site or cancel your registration if you do not wish to continue to use the Site and the Services under the new ownership. You may not assign, transfer, or sublicense these Terms of Use to anyone else and any attempt to do so in violation of this section shall be null and void.

I, the User or Patient, or Consumer

  • Understand the risks and benefits of the online consultation
  • Acknowledge and agree to assume the risk of the above-mentioned limitations pursuant to the use of eHealthdoc. I further understand and agree that no warranty or guarantee has been made to me concerning any consultation on a particular diagnosis, result, treatment, or cure of my condition.
  • I understand that the laws that protect privacy and the confidentiality of medical information also apply to eHealthdoc
  • I understand that the consultation through eHealthdoc may involve electronic communication of my personal medical information to other medical practitioners who may be located in other areas, including out of state.
  • Consultations on eHealthdoc are not intended to substitute a physical consultation with a doctor or hospital services. The service should not to be used for medical emergencies. The service offers expert opinions of qualified doctors and medical advice on various medical conditions, medical diagnoses, and treatments, and in case of the online consultation and the provision of a medical certificate it does not include a direct medical diagnosis, treatment, or prescription
